
I Sued The SEC

On July 27th, 2024, me & Brian Frye sued the SEC on behalf of NFTs. You remember what it was like back then: Every day saw Gary Gensler issuing Welles Notices & enforcement actions against crypto projects. We set out with a simple goal: Force the question to be answered once and for all. “Are NFTs securities?” At the heart of the lawsuit was THIS VERY NFT PROJECT that you are about to mint. I am pretty sure that this project (and Brian’s) are the first ever NFT projects to be featured in a federal lawsuit. Over the next year, our intrepid lawyer fought this battle on our behalf through legal briefings and oral arguments. And then: TRUMP. Once he was elected, everything changed for our lawsuit. The SEC was remade and enforcement actions ceased. And before long, our case had been dismissed. That was the end of our lawsuit. Earlier this year, the SEC put out real guidance saying that indeed, NFTS are NOT securities. We lost the battle, but won the war. Long live NFTs.
